OPINION
MICHAEL, District Judge.
Plaintiff Rubbermaid Commercial Products, Inc. (“Rubbermaid”) is a Delaware corporation with its principal place of business in Winchester, Virginia. Defendant Contico International, Inc. (“Contico”) is a Missouri corporation having its principal place of business in St. Louis, Missouri. Rubbermaid’s complaint is for patent infringement, trade dress infringement and unfair competition in violation of § 43(a) of the Lanham Act, and common law trademark infringement.
