OPINION
YOCK, Judge.
This military pay case is before the Court on the defendant’s Motion to Dismiss or in the Alternative for Summary Judgment. The plaintiff has countered with a Cross-Motion for Summary Judgment, filed May 24, 1993. At issue is a determination by the Secretary of the Air Force, entered pursuant to the recommendation of the Physical Disability Appeals Board (“PDAB”), finding the plaintiff fit for duty, and retaining him in the Air Force in active status.
