This suit was instituted in the district court of Dallas county, Texas, by the plaintiff, Rosa L. Aldridge, a widow, against the defendant, Tokio Marine & Fire Insurance Company. The defendant urged a plea of nonjoinder, alleging in such plea that the policy sued on was made payable, in the event of loss or damage, to Frank B. Dunlap, trustee, as his interest may appear, and such trustee was a necessary party in the case. The court sustained defendant’s plea of nonjoinder, and Frank B.
