OPINION

LYDON, Judge:

In this construction contract case, plaintiff seeks to recover damages on behalf of itself and on behalf of Continental Drilling Company (Continental), its subcontractor, from defendant arising out of its construction of the Nambe Palls Dam in New Mexico for the Bureau of Reclamation, Department of the Interior (BOR). Plaintiff filed its petition (complaint) in this court as a direct access ease under section 10(a)(1), (3) of the Contract Disputes Act of 1978, codified at 41 U.S.C. § 609 (1982).
