The city of Roanoke proposes to erect an overhead *557bridge the full width of and over Walnut avenue, beginning at grade at its intersection with Jefferson street and extending across the tracks of the Virginian Railway and the Norfolk and Western Railway to a point on the east side of Roanoke river. This proceeding, by petition, was instituted by the city under the eminent domain act, chapter 176 of the Code of Virginia, to have the damages for the property taken and to the property no part of which was taken ascertained by commissioners appointed by the court.
