sitting in place of MR. JUSTICE ANGSTMAN, delivered the opinion of the court.

Relators ask for writs of mandate to compel the Secretary of State to file their primary nominating petitions and to print their names on the ballot for the primary election to be held July, 1934.

At the general election in 1932, Honorable J. E. Erickson and Honorable Frank H. Cooney were elected Governor and Lieutenant-Governor, respectively, of the state of Montana. On the thirteenth day of March, 1933, Erickson resigned. On the sixth day of June, 1934, the relators tendered…
