ORDER ON PLAINTIFFS’ MOTION FOR SUMMARY JUDGMENT
PITTMAN, Chief Judge.
Plaintiffs filed this suit pursuant to 42 U.S.C. §§ 1981 and 1983, and 28 U.S. C. § 2201. They seek a judgment declaring a section of a State statute and a section of an ordinance of the City of Mobile unconstitutional, awarding back pay along with general and punitive damages, and granting an attorney’s fee. Plaintiffs also seek to maintain this suit as a class action pursuant to Rule 23, F. R.Civ.P.
