This appeal is from an August 9, 1990 order that (1) granted the motion for summary judgment of appellee, West Penn Power Co. (“West Penn”), and (2) granted judgment on the pleadings in favor of West Penn on appellant's counterclaim.1 The trial court granted judgment *469premised upon application of this Court’s decision in West Penn Power v.
