I. PROCEDURAL HISTORY AND SUMMARY

As described in detail in this court’s decision concerning Raymond J. Patriarca’s ini tial sentencing, the defendant has pled guilty to conspiring to violate, and violating, the Racketeer Influenced and Corrupt Organizations (“RICO”) Act, 18 U.S.C. § 1962(c) and (d), and to several violations of the statute prohibiting interstate travel in aid of racketeering, 18 U.S.C. § 1952 (the “Travel Act”), which were also alleged to be RICO predicates.
