Local 285, Service Employees International Union, AFL-CIO, CLC (“the Union”), submitted grievances for two discharged employees, Justin Onanibaku (the “Onanibaku grievance”) and Mildred Singh (the “Singh grievance”), pursuant to the grievance/arbitration procedure contained in its collective bargaining agreement with Nonotuck Resource Associates, Inc. (“the Company”). The Union alleged that both employees were discharged without “just cause.” The Company refused to submit to arbitration, maintaining that neither grievance was arbitrable under the collective bargaining…
