MEMORANDUM AND ORDER

MacLAUGHLIN, District Judge.

This matter comes before the Court on plaintiffs’ motion for a new trial. Plaintiffs, who are Native Americans, brought this action under 42 U.S.C. §§ 1983, 1985, with pendent common-law tort claims of assault and battery, charging defendant police officers with beating them in the course of their arrest and delivery to jail. Plaintiffs also sued the City of Minneapolis, alleging that the city was liable for the actions of defendant officers under the doctrine of respondeat superior and for negligence.
