Anthony Cacace v. United States

Court of Appeals for the Fifth Circuit

Decided March 8, 1979No. 78-1511PublishedCited by 8 opinions

1Per curiam

Anthony Cacace was convicted on a one-count indictment of conspiracy to distribute cocaine hydrochloride in violation of 21 U.S.C. § 846. On direct appeal he asserted that an affidavit of application securing wiretap authorization did not comply with 18 U.S.C. § 2518(l)(c). This court found compliance and affirmed the conviction. United States v. Cacace, 5 Cir., 529 F.2d 1167, cert. denied, 429 U.S. 841, 97 S.Ct. 115, 50 L.Ed.2d 109 (1976). Cacace now appeals from the denial of his motion for post-conviction relief pursuant to 28 U.S.C. § 2255. We find no merit in his contentions and affirm.
