This action was commenced in the district court oE Kiowa county on the 25th day of July, 1910, by the defendant in error as plaintiff against the plaintiff in error as defendant. The parties will be referred to hereafter as they appeared in the trial court.

The petition alleges, in substance, that David E. Haile was an imbecile and incompetent; that he was the owner of a certain tract of land; that the defendant acting through its officers and agents, with the intent to defraud him, and with full knowledge of his imbecility, inveigled him into its bank on two different occasions…
