This action was instituted by the plaintiff pursuant to Section 205(g) of the Social Security Act, as amended, 42 U.S. C.A. § 405(g) 1 to review a decision of the Secretary of Health, Education and Welfare, denying the plaintiff disability benefits to which he is allegedly entitled.

By this motion plaintiff seeks summary judgment pursuant to Rule 56(b) of the Federal Rules of Civil Procedure, 28 U.S. C.A., on grounds that there are no genuine issues as to any material facts and that he is entitled to judgment as a matter of law. Defendant has cross-moved for…
