McDONALD, J.

Defendant Christopher Conley, a peace officer then employed by the Sheriff of San Bernardino County, was involved in an off-duty incident that resulted in his conviction of one count of misdemeanor battery. At the sentencing hearing, Conley petitioned for an order under Penal Code section 12021, subdivision (c)(2) 1 relieving him of the 10-year firearm prohibition prescribed by section 12021, subdivision (c)(1).
