Reversing.

This declaratory' judgment action was filed in the Powell circuit court by appellant, and plaintiff below, Rose C. Conlee, against the other heirs, children and grandchildren of Lina Conlee, the latter having executed her will on April 12, 1912, and died on February 13, 1913.

Lina Conlee resided with her husband and some of her children at the time of executing her will, and at her death, in Powell County, Kentucky. She left seven children who survived her with one predeceasing her leaving three surviving children who were grandchildren of…
