BACKGROUND

The parties to this action, Guaranty National Insurance Company (“Guaranty”) and American Motorists Insurance Company (“American”), provided motor vehicle liability coverage to a common insured for a third party personal injury claim which arose out of a vehicular accident. The liability insurance contract extant between Guaranty and the insured had a limit of liability of $25,000.00.
