This case is before the court on defendant’s motion to dismiss plaintiffs’ complaint for lack of subject matter jurisdiction, or, in the alternative, failure to state a claim upon which relief can be granted pursuant to Rules 12(b)(1) and (4) of the Rules of the United States Court of Federal Claims. Plaintiff claims that his retirement from the United States Public Health Service (PHS) Commissioned Officer Corps was involuntary.
