The appellee, Andrew Parsons, brought this suit in the Kenton circuit court to recover damages of the appellant, city of Covington, and C. C. Lowry, for injuries to his house. For his cause of action appellee, plaintiff below, alleged in substance “that the defendant, city of Covington, entered into a contract with its co-defendant, C. C.
