This is an action at law to recover brokerage commissions: which Frank V. Atkinson, the plaintiff below, claimed he had earned in effecting a sale of certain real property owned by Mrs. Justine L. Nusbaum, one of the defendants. The plaintiff alleged that he had been employed to make the sale by V. H. Nusbaum, the husband of the owner of the property, and by S. L. Nusbaum & Company, Inc., a corporation, of which V. H. Nusbaum is the president. The case was submitted to the trial court without a jury upon a written stipulation of facts and resulted in a finding and judgment, for the defendants…
