Plaintiff Coy G. Cox, Jr. filed two successive personal-injury actions against Specialty Vehicle Solutions, LLC (“SVS”), which was in bankruptcy proceedings at the time. The district court dismissed the first suit as invalidly filed in violation of the bankruptcy automatic stay, and dismissed the second suit — filed after the bankruptcy court granted relief from the stay — as untimely under the applicable Kentucky statute of limitations.
