OPINION

ROBERT G. DOUMAR, District Judge.

The above-styled case comes before this Court upon the Defendant Barry Stokley’s (“Stokley”) Motion to Dismiss pursuant to Federal Rule of Civil Procedure 12(b)(6), filed on April 7, 2009. The Plaintiff Board of Trustees for the Hampton Roads Shipping Association — International Longshoremen’s Association (“Board”) filed an Opposition on April 21, 2009. Stokley did not file a Reply. The Motion to Dismiss is therefore ripe for review by this Court.

For the reasons set forth herein, the Court GRANTS in part and DENIES in part Stokley’s Motion to Dismiss.…
