This action is founded on an alleged breach of a' County Treasurer’s bond erroneously executed to the County of Grand as obligee, instead of to The People of the State of Colorado, as the statute provides. The condition of the bond was in substance, as provided by the statute, for the faithful perform*28anee by James C.
