OPINION

GERRY, District Judge.

This matter comes before this court on an application by the plaintiff for an order adjudging the defendant Robert C. Ciampit-ti in contempt of a permanent injunction issued by this court on November 28, 1984, imposing a coercive monetary penalty to induce the defendant’s compliance with that order, and for an order imposing substantial civil penalties under the Federal Water Pollution Control Act (Clean Water Act), 33 U.S.C. § 1251, et seq.
