The plaintiff, Earl E. Crouse, resides on the Allegany Reservation of the Seneca Nation of Indians, of which he is an enrolled member. On October 5, 1978, he obtained a loan from defendant, First Trust Union Bank of Salamanca, New York, in the stated sum of $1,400. Such $1,400 loan represented a balance of $928.51 due from the original financing of a 1972 Pontiac Grand Prix automobile and subsequent loans in which that vehicle was pledged as collateral security.
