Negotiations were begun between them, looking to a settlement of the wife's -claim for alimony. On December 8, 1900, both parties signed an agreement to live thenceforth separate and apart from each other, and J. L. Sumner executed a paper in which he agreed to make to his wife “ a deed of conveyance” to described land, and to give her certain personal property. (After stating the foregoing facts.) 1. The order . allowing additional attorney’s fees can not be reviewed, because no sufficient assignment, of error has been made thereon. Sumner’s bill of exceptions contains merely a recital that such an order was passed and that exceptions pendente lite thereto were filed, but does not assign error either on the order or the exceptions pendente lite.
