This was an action by a widow to recover damages for the homicide of her husband. There was a verdict for the defendant, and a motion for new trial by the plaintiff, which was overruled. The judgment overruling the motion was rendered more than sixty days after the trial; notwithstanding which fact, the defendant sued out a cross-bill of exceptions, complaining of a ruling of the court made on the trial.
