The Walton Guano Company sued Copelan in the ■county - court, and the case was carried by appeal to the superior court. The action was on a promissory note in which it was stip*320ulated that the indebtedness might be discharged in cotton of a designated grade, in merchantable bales, at ten cents per pound, if delivered at or before the maturity of the note.
