Kogler brought this action in the District Court against the Alien Property Custodian and Rudolph Chillingworth under the Act of Congress of October 6, 1917, commonly known as “Trading with the Enemy Act.” 40 Stat. at Farge 411, 419 (Comp. St. 1918, Comp. St. Ann. Supp. 1919, §§ 3115%a-n3115%j). *443By his bill he averred that Chilliugworth was an alien enemy within the meaning of the Act, owning stock of a New Jersey corporation later acquired and sold by the Alien Property Custodian; _ that early in 1914 he contracted with Chilliugworth to render services to the…
