In this proceeding it was sought to determine whether Michael Manley or J. S. Shaffer is entitled to perform the services and receive compensation as morgue keeper of Hennepin county during the year *144of 1909. The controversy was submitted to the district court upon agreed facts, as authorized by section 4286 of the Revised Laws of 1905, and Shaffer appealed to this court from a judgment entered in favor of Manley.
