MILLER, Judge.

Chief Judge Smith by order entered March 3, 1998, transferred the Statesman case to this court.1 At the time of the transfer, Chief Judge Smith had pending before him four pre-trial motions — Plaintiff Federal Deposit Insurance Corporation’s Motion for Partial Summary Judgment Regarding Liability, Defendant’s Cross-Motion for Summary Judgment, Defendant’s Motion To Dismiss Certain Claims of the FDIC as Receiver, and Plaintiffs’ Motion for the Direct Recovery of Monetary Relief from the United States.
