MEMORANDUM and ORDER

WEINSTEIN, Chief Judge:

Defendant was found guilty by a jury of conspiracy to distribute and to possess with intent to distribute heroin (21 U.S.C. §§ 841 (b)(1)(A)(i) and 846) and of offering a bribe to an agent of the United States Customs Service. 18 U.S.C. §§ 201(b) and 3623. He seeks a new trial.

Prior to trial defendant moved to suppress the deposition of a key prosecution witness who was deposed in France. He contends that the unreliability created by the conditions surrounding the deposition made its use at trial a violation of the evidentiary rules against admission…
