Magney, Justice.

An information in the nature of quo warranto to test the right of respondent to the office of deputy sheriff for Hennepin county was filed in this court and writ issued. The attorney general consented to the institution of this proceeding.

Eelator, James C. Finnegan, is a citizen, voter, and taxpayer of Hennepin county. He served as deputy sheriff during the incumbency of Sheriff Earle Brown. Ed. Eyan was elected sheriff to succeed Brown on November 5, 1946, and qualified as such on January 6, 1947. Ryan did not appoint relator as deputy or to any other position in Ms office.…
