OPINION
BOGGS, Circuit Judge.
In this diversity action, Dana Henderson appeals a grant of summary judgment to her employer, Ardco, Inc. (“Ardco”). Henderson alleges that Ardco violated KY. Rev.StatAnn. §§ 342.197 and 344.040 (Mi-chie 1997), which forbid retaliatory discharge for filing a claim for workman’s compensation and employment discrimination against “a qualified individual with a disability.” Below, Henderson also alleged gender discrimination, but has now abandoned this claim on appeal.
