T. R. Frank sued B. F. Jones and C. TV. Lumpkin for damages for an alleged conspiracy to fraud. The cause was tried to a jury, and verdict returned for defendants. Motion for new trial was filed and overruled. Thereafter, during the term, defendants filed a second motion for new trial, alleging that one of the defendants had treated the jury to dinner during the progress of the trial.
