The facts in the case at bar are set forth in a stipulation filed by counsel for the parties reading as follows:
IT IS HEREBY STIPULATED AND AGREED by and between counsel for the plaintiff and the Assistant Attorney General, attorney for the United States, that the merchandise, a floor covering in the form of tiles. 10% inches by 10% inches, %e of an inch in thickness, some grey-green and others tan in color, covered by the above enumerated protest was assessed with duty at the rate of 17% ad valorem plus 21 cents per pound under paragraph 1589(b), Tariff Act of June 17, 1930,…
