The questions presented for consideration in this case arise on a petition filed in the county court of the City and County of Denver by Eugene W. Clarke, a son and heir of Yiola A. Clarke, deceased, herein called the petitioner, to construe certain portions of the will of deceased, which will, prior to the filing of such petition, had been admitted to probate.
