BULLOCK, District Judge.
On December 22, 2000, the Attorney General of the United States acting at the request of the Administrator of the United States Environmental Protection Agency (“EPA”) filed this action against Defendant Duke Energy Corporation (“Duke Energy”). The EPA alleges that Duke Energy made modifications to and operated eight coal-fired electrical generating plants in North Carolina and South Carolina in violation of the Clean Air Act (the “CAA” or “Act”), 42 U.S.C. § 7401 et seq., specifically the Prevention of Significant Deterioration (“PSD”) provisions of…
