DECISION AND ORDER
SIRAGUSA, District Judge.
Now before the Court is the defendant’s motion to dismiss or in the alternative, to stay [# 6]. For the reasons that follow, the defendant’s motion to dismiss the action is granted.
BACKGROUND
The plaintiff advertising agency is a New York corporation with its principal place of business in Rochester. The defendant is a Delaware corporation with its principal place of business in Birmingham, Aabama.
