The following is appellant’s statement of the case, which is accepted by appellee: “This suit was instituted by appellant, L. T. Bowman, in the district court of Hemphill County, Texas, on November 13, 1903. The original petition stated in substance that the plaintiff resided in Roger Mills County, O.
