This suit was brought by J. O. Ross and H. Masterson, resident citizens of the state of Texas, against the Banco Minero, a corporation organized under the laws of the state of Chihuahua, republic of Mexico, with its principal office and place of business in the city of Chihuahua, to recover against the defendant the sum of $40,000, with interest from the 30th day of July, 1907, at the rate of 6 per cent, per annum.
