HAMITER, Justice. •

The Board of Commissioners of the Port of New Orleans (sometimes referred to hereinafter as Dock Board) seeks in this cause to recover from the Public Belt Railroad Commission for the City of New Orleans (hereinafter sometimes termed Public Belt), as a third person tort-feasor, amounts paid and to be paid under the Louisiana Workmen’s Compensation law to the dependent, illegitimate, minor daughter (a member of the family) of one of plaintiffs employees who died by reason of an accident occurring during the course and within the scope of his employment.
