This is a civil action brought in the United States District Court for the Eastern District of South Carolina by the Administrator of the Estate of William Neese to recover damages under the Federal Employers’ Liability Act, 45 U.S.C.A. § 51, for the death of William Neese, allegedly caused by the negligence of the Southern Railway Company (hereinafter called Southern), a railroad engaged in interstate commerce.
