DONALD RUSSELL, District Judge.
In this action to recover damages both for wrongful death (Section 10-1951 et seq., Code of South Carolina, 1962) and for pain and suffering (Section 10-209, Code of South Carolina, 1962), filed under the Federal Tort Claims Act, the defendant has conceded that the injuries sustained by the decedent, resulting in the latter’s death, were due to the negligence of the defendant’s authorized agent.
