Presently before the Court are two motions for summary judgment. Plaintiffs Jimmy Schlier and Wreckers International, Inc., move for partial summary judgment on liability against Defendants Major John G. Rice and Col. Jeffrey B. Miller, in both their individual and official capacities, for violation of Plaintiffs’ First Amendment rights. (Pis.’ Mot. for Partial Summ. J., Doc. 89.) Defendants John G.
