Appeal from an order of the Supreme Court (McDermott, J.), entered February 2, 1988 in Albany County, which, inter alia, denied defendant’s cross motion for summary judgment dismissing the complaint.
Plaintiffs orally retained defendant as an attorney to represent them in the purchase of real property in the Town of Bethlehem, Albany County. The closing was held on November 25, 1981 and plaintiff executed a note and purchase-money mortgage to the seller, Mary Deitz. Subsequently, plaintiffs ran into financial difficulties and sought to sell the property to pay off the mortgage.…
