Upon an information charging defendant with murder in the first degree, ]ie was convicted of murder in the second degree and sentenced to the penitentiary, and now-presents his appeal from said judgment to this court. Defendant was convicted of having murdered his wife by shooting, in the dining room of their home, at a time when1 defendant, his wife and small baby and one Tooley, a lodger, were the only persons in the house.
