On May 20, 1911, W. T. Fitzpatrick, a successful farmer and business man of Mt. Sterling, was found to be a person of unsound mind and incompetent to manage *786his estate, by an inquest and judgment of the Montgomery county court. A. S. Hart qualified as committee and shortly thereafter instituted an action in the Montgomery county court to settle the estate of Fitzpatrick.
