BIRCH, Circuit Judge:
William O. Steele appeals his conviction for dispensing controlled substances in violation of 21 U.S.C. § 841(a)(1), and the government cross-appeals the district court’s application of the U.S. Sentencing Guidelines. Steele argues that his conviction must be vacated on three grounds: (1) the indictment was insufficient to allow him to prepare a defense and protect against double jeopardy; (2) the government improperly used its peremptory strikes based on gender; and (3) insufficient evidence existed to support his conviction.
