This is the fourth appeal arising out of a dispute between an employee, Gary Wayne Madewell, and his employer, Miller and Miller Construction Company, Inc., concerning the employer's claim to subrogation as to funds recovered by the employee pursuant to a $400,000 settlement of a separate third-party tort action.
